Vista Detention Center Arrest Process

There are many bail bond laws that need to be followed and we realize it’s confusing and stressful at the same time.  The Vista jail booking process in Encinitas and at the Vista jail can take anywhere from 4 – 8 hours.
The bail bond process starts at Vista Detention Center. Once someone has been arrested in Encinitas, they are taken to the Encinitas Sheriffs Department office on El Camino Real for questioning.   They are then transferred to the Vista Detention Center in Vista, CA.  There, they begins the long process of getting fingerprinted and bailed out of jail.

The booking process takes 4-8 hours to be processed before an Encinitas bail bond can be posted.  When the defendant is going through the booking process, they take their fingerprints and photographs.  The fingerprints are then forwarded to the FBI and the defendant's records are searched nationwide for any outstanding warrants. The defendant’s personal belongings are collected and put away including all monies, credit cards, cell phones, jewelry and any other personal property that they have in their possession.  After this process is complete, the person arrested is placed in a jail cell where they have access to a telephone. In the Vista Detention Center, the defendants can call out to their loved-ones or call Encinitas bail bonds to start the bail bonding process. All Encinitas bail bondman numbers are on the wall at 760-944-6900.

After the Vista Detention Center arrest process is completed, three things could happen:

1) The bail bond amount will be set according to the San Diego Superior Court Bail Schedule.  An arraignment date is set within 72 hours but may change if the defendant bails outs use an Encinitas Bail Bondsman.  Felonies require an appearance 7 – 10 days later after they bail out of the Vista Detention Center. Misdemeanors usually require the defendant to appear 1-2 months after the date they post a bail bond.  Usually during the Vista jail booking process, an agent from Encinitas bail bonds will meet with the family members who are co-signing for the bail bond.  This is assurance that the defendant will show up for all their court cases at the San Diego Superior Court North County Division in Vista Ca.

2) For lesser crimes and misdemeanors, the Vista jail booking supervisor may determine that the defendant may be released with a written promise to reappear in court at a later date on their “Own Recognizance” or OR.  Being released on OR doesn’t require a bail bond to be written.  If the defendant doesn’t show up to their arraignment or court cases, the judge with issue a San Diego warrant for their arrest. Since Prop 47 passed in 2014, numerous jails in California have been giving those newly arrested OR releases for misdemeanors and minor crimes.  Whether they will show up for their court dates are yet to be seen but most fail to appear.

3) If the defendant is unable to bail out or they can’t afford an Encinitas bail bond, they will be seen by a Superior Court Judge within 72 hours.  This is called an arraignment where they plead either innocent or guilty of the misdemeanor or Felony.  Once they plead innocent, the judge will then discuss the amount of the bail and adjust it either higher or lower.  Waiting until the arraignment in the Vista jail for a lower bail can save families thousands of dollars. However, the risk is that the bail bond might be higher according to the judge which makes it even harder to bail out of the Vista Detention Center.
